Terms of use

User Agreement

1. Application

This User Agreement (the “Agreement”) sets forth the legally binding terms and conditions for your use of the Services provided by Segem Micromobility AB, org.nr 559278-5496 (“Segem or We”).

2. Definitions

"User" - Refers to an individual person who registers a My Segem account.

"License" - Refers to the right to use and access the My Segem application.

"Account" - Refers to the User's login to the My Segem app, from which the User can unlock and lock the scooter, view historic travelling information and statistics, update payment methods and user details, etc.

“Services” means the use of the Segem scooter and the Segem App and its related services made available through the Website or the My Segem App, together with any other related equipment services, and information made available by Segem.

3. Register an account

When you purchase your Segemscooter a user account for the My Segem app is automatically created as this is a prerequisite for the use of the vehicle.

Each vehicle can only be connected to one account, but each User can have several connected vehicles.

4. Conditions for use

All use of the Segem services is conditional upon you as the User accepting this User Agreement, which you also confirm when you purchase your scooter and the account is created.

You can stop using the service at any time and deactivate your My Segem account. Please note that if you deactivate your My Segem account you will no longer be able to use your scooter. These conditions apply for as long as there is an active user account.

5. Use of the service

As a User, you are responsible for all use of the Service and for your login information to be protected from unauthorized access. It is not allowed to transfer or allow someone else to use your account. You agree to notify Segem immeadiately of any unauthorized use of your account or password or any other breach of security.

By accepting this User Agreement, you warrant that you will not use the Service for any purpose that violates applicable laws or otherwise may cause harm or inconvenience to Segem or any third parties.

You are responsible for following applicable traffic rules and must adapt your driving to external circumstances, such as your own ability and experience, current weather conditions and other factors that may pose a risk during use. Segem cannot and will not be liable for any loss or damage arising from your failure to comply with these obligations.

6. Compliance with local laws and regulations

In addition to what has been stated above, you agree to at all times use the Services in compliance with any locally applicable laws, regulations and rules. You understand that you are solely responsible and liable for any violation of any laws, regulations and rules in relation to Your use of the Services.

7. The services

Through your My Segem account you are always in direct contact with your vehicle as the Segem scooter uses the 4G network to stay connected at all times.

The My Segem app on your mobile is the key to your scooter.

Through the My Segem app you can follow your vehicle in real-time on the built-in map. Adjust settings for lights and sounds. Give friends and family permission to unlock and drive your vehicle (and configure the maximum top speed for each driver).

Wherever you are you will receive push notifications if your scooter has tipped over or someone unauthorized tries to move it. You can also configure whether the vehicle should trigger an alarm via sound and flashing lights to call for the attention of others or if the alarm shall remain silent.

To ensure that you can feel extra confident that everything works as it should before your next trip the vehicle performs self-checks. In the event any hardware failures is detected, an alert is sent to notify you through the app.

8. Price and Payment Terms

When you purchase your scooter we give you auser license and a 1-year 4G connectivity fee for free. After the first year you will need to renew your connectivity subscription annually to continue using you scooter. Information about our current connectivity fees can be found on our webpage.

The connectivity fee is paid by credit card in advance directly in the My Segem app.

9. Processing of personal data

When you register a My Segem User Account, Segem will process your personal data in order to provide the Service and to fulfill our obligations according to this Agreement. All personal data will be processed in accordance with our privacy policy.

By entering this User Agreement you confirm that you have acknowledged and agree that Segem will collect location data, such as the GPS-position of your scooter and your phone, speed and travel direction, continuously in order to provide our services.

We ask that you read the privacy policy carefully so that you understand how Segem uses and processes your personal data.

10. Updates and further development

Segem plans to continuously develop, update and improve the Segem services.

All further development is included as part of the subscription and the use of new functionality shall be in accordance with this User Agreement, unless Segem informs that the new functionality requires special conditions.

11. Intellectual property rights

All copyrights, trademarks, company names, logos and other intellectual or industrial property rights owned and used by Segem as well as those contained in the Segem app or on the Website (including headings, graphics, symbols, scripts, source codes, etc) is Segem's property or licensed property of a third party and may not be reproduced, distributed, sold, used, modified, copied, restricted or used (in whole or in part) without prior written consent.

You may not modify, attempt to gain unauthorized access to, alter, infringe on, repair or otherwise alter any of Segem's software, source codes or information for any purpose.

The Segem App, Website and scooters may only be used for purposes consistent with this Agreement.

You agree that the Services and other information, including all related intellectual property rights, provided and made available by Segem will always remain Segem's exclusive property and that you may not in any way use Segem's exclusive rights for commercial or other purposes without Segem’s prior written consent.

12. Limitation of liability

Segem intends to keep the services available at all times. However, we cannot guarantee the availability of the service and cannot be held liable if the service is down or if any functionality does not work as expected.

For the avoidance of doubt, Segem shall under no circumstance be liable for damages caused by substandard or lack of maintenance of your Scooter or normal wear and tear of brakes or other consumable parts, etc.

The total liability of Segem, for all claims under these terms, including for implied warranties, shall be limited to the amount paid by the Customer for the use of the Service.

Under no circumstances shall Segem be liable for any loss or damage that is not reasonably foreseeable.

13. Segem’s right to suspend Users

Segem reserves the right to unilaterally decide to suspend Users from use of the Service.

Suspension may occur, for example, as a result of a violation of these terms and conditions or if the service is used in a manner that may cause Segem or any third party damage. Suspension can be made without prior notice.

15. Amendments and additions

Segem reserves the right to change these terms from time to time. The up-to-date terms are always published on our website.

16. Governing Law and Dispute Resolution

Any dispute concerning the application or interpretation of these terms of purchase shall be finally settled by the Swedish general courts in accordance with Swedish law.

The dispute may also be resolved by the Swedish National Board of Consumer Disputes (Sw: Allmänna reklamationsnämnden) or by using the European Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr).
